Please read these Terms of Use (“Terms”) carefully before using the https://www.simpleabm.com/
website (the “Service”) operated by SimpleABM, a division of Metrix Marketing, located in Surrey, British Columbia, Canada (“us”, “we”, or “our”).
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, you do not have permission to access the Service.
Purchases
If you purchase any product or service made available through the Service (“Purchase”), you may be asked to supply certain information relevant to your Purchase, including your credit card number, expiration date, billing address, and shipping information. You represent and warrant that:
- You have the legal right to use any credit card(s) or other payment method(s) in connection with any Purchase.
- The information you provide is true, correct, and complete.
We may use third-party services to facilitate payment and completion of Purchases. By submitting your information, you authorize us to provide that information to such third parties, subject to our Privacy Policy.
Availability, Errors, and Inaccuracies
Subscriptions
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). Billing cycles are set on either a monthly or annual basis, depending on the plan selected. Subscriptions will automatically renew under the same conditions unless cancelled by you or by us.
A valid payment method is required to process subscription payments. By submitting payment details, you authorize us to charge Subscription fees. If automatic billing fails, we will issue an electronic invoice for manual payment.
Free Trial
We may, at our sole discretion, offer a Subscription with a free trial for a limited period (“Free Trial”). If billing details are provided during signup, no charges will apply until the Free Trial has expired. Unless cancelled before the final day of the Free Trial, you will be automatically charged the applicable Subscription fee. We reserve the right to modify or cancel Free Trial offers at any time without notice.
Fee Changes
We may change Subscription fees at any time. Any change will take effect at the end of the current Billing Cycle. We will provide reasonable notice so you may cancel before the new fees take effect. Continued use of the Service after changes constitutes agreement to pay the updated fees.
Refunds
Accounts
When you create an account, you confirm you are over 18 years of age and that all information provided is accurate, complete, and current. Failure to maintain accurate information may result in termination.
You are responsible for safeguarding your account and password, and for all activities under your account. You must notify us immediately of any breach or unauthorized use. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.
Intellectual Property
The Service and its content, features, and functionality remain the exclusive property of SimpleABM (Metrix Marketing) and its licensors. The Service is protected by Canadian and international copyright, trademark, and other laws.
Links to Third-Party Websites
Our Service may contain links to third-party websites not owned or controlled by SimpleABM. We assume no responsibility for the content, privacy policies, or practices of third-party sites or services. You acknowledge that we are not liable for any damage or loss related to use of or reliance on such external content. We recommend reviewing the terms and policies of any third-party websites you visit.
Indemnification
In no event shall SimpleABM, Metrix Marketing, or their directors, employees, agents, or affiliates be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:
- Access to or inability to use the Service.
- Conduct or content of any third party.
- Content obtained from the Service.
- Unauthorized access to or alteration of your data.
